Wills + Trusts + Powers of Attorney

If you are one of the 69% of people who don’t even have a Will, then there is a strong likelihood of conflict and Court for the people you love. Or maybe you do have a Will, but you are unsure whether that Will alone is enough to make sure your family will stay out of court and conflict if you become incapacitated or when you die.

We at the The Toma Firm take an educational and comprehensive approach to Estate Planning to help guide you in creating a plan that works for you and your family when they need it the most. If you have children or special needs family members, we will work with you to ensure they are taken care of by the people you want, in the way you want, no matter what.

Some of the questions we focus on with Client are:

  • The best way to title assets to ensure that your family doesn’t get stuck in court if you become incapacitated.
  • How to ensure that the assets you to leave to your children and loved ones are protected from creditors, divorce and even bankruptcy.
  • Why preparing for your possible incapacity is the best gift you can give your family.
  • How to pass on more than just your assets, and leave a true legacy.
  • That facing the reality of your death (and planning for it) is the path to creating a life worth living.

GUARDIANSHIP AND CONSERVATORSHIPS

Does a member of your family suffer from a mental or physical disability and unable to adequately make financial or healthcare decisions for themselves? If so, these individuals may need a guardianship (healthcare) or conservatorship (financial) filed on their behalf.

Guardianships and conservatorships may also be necessary for minors, either because the parents are not able to provide necessary care or, in the case of conservatorships, because of an inheritance or other financial windfall that must be managed for them.

We at The Toma Firm can assist you with a Guardianship or Conservatorship suits and weigh possible alternatives including the implementation of estate planning tools, like Special Needs Trusts. Whatever the need, we are here to assist you and your family with empathy and understanding.

Probate – Contested + Uncontested

When a loved one passes away, legal issues and court intervention are often inevitable. When a deceased person owned real estate, stocks, bonds, or bank accounts, it is likely that an estate will need to be opened with the probate court. One misnomer is that a Will avoids court involvement… this is not true. In fact, a Will is designed to be used by the courts to administer a deceased individual’s estate.

The probate process in Georgia is, in many ways, less complicated and expensive than in other states. However, it can still be confusing and problematic, especially for folks engaging with the probate process for the first time.

We at The Toma Firm are your partners to walk through the probate process step by step and make and often times difficult situations as simple and painless as possible.

Contract Disputes + Real Estate Litigation

Whether you have been damaged by another individual or business failing to ‘hold up their end’ or accused of committing a contractional breach, we are here to help. We have represented contractors, landowners, business owners, and individuals who have been harmed by another’s failure to perform under an agreement. We can protect you by filing a lien, initiating a dispossessory action (eviction), and any other method necessary to protect you from bearing another’s responsibility.

If you have a contractual dispute, memorialized in writing, or cemented by a handshake, we are here to fight for you.

Personal Injury

Did you know that Georgia has a strict two-year statute of limitations for filing a personal lawsuit? This mean that you have two-years from the day you are injured to pursue compensation.
